Gardner Trucking, Inc. Settles For $27,200.00
In August 2019, the California Air Resources Board (CARB) settled a case for
$27,200.00 with Gardner Trucking, Inc. (GARDNER), located in Chino, California. CARB documented violations by GARDNER for:
- Failure to bring nine of their on-road diesel fueled vehicles into compliance with the applicable in-use performance standards under the Truck and Bus regulation, pursuant to California Code of Regulations, title 13, section 2025 (13 CCR § 2025);
- Failure to bring five of their transport refrigeration units (TRUs) into compliance with the applicable in-use performance standards under the TRU Air Toxic Control Measure (ATCM), pursuant to 13 CCR § 2477; and
- Failure to properly self-inspect eight diesel trucks to ensure the trucks met state smoke emission standards as required by the Periodic Smoke Inspection Program (PSIP), pursuant to 13 CCR § 2190-2194.
GARDNER entered into a settlement agreement with CARB and agreed to pay a total penalty amount of $27,200.00 for their violations. In addition, GARDNER agreed to replace their diesel-fueled vehicles to be in full compliance within specified timeframes, and to disable their non-compliant TRUs. GARDNER was cooperative with submitting documentation during the course of the audit and agreed to become compliant with California’s air quality regulations within the requested timeframe.
