Fresh Express Case Settles for $37,425
In June 2010, Fresh Express agreed to pay $37,425 in penalties for violating air quality regulations; $28,068.75 went to the California Air Pollution Control Fund and $9,356.25 to a Supplemental Environmental Project (SEP) intended to install electric “shore-power” at shipping dock doors of the Fresh Express facility at 900 E. Blanco Rd. in Salinas. Fresh Express self-reported that they failed to submit a report of the TRU activity at their facility by the required deadline. Large cold storage facilities were required to submit this one time report by January 31, 2006 as set forth by 13 CCR Section 2477(f)(2). Fresh Express also failed to maintain PSIP records for some of their vehicles as set forth by 13 CCR Section 2192. Fresh Express has now submitted a complete TRU large facility report and PSIP records for all vehicles and agreed to pay the $37,425 penalty and to comply with the TRU and PSIP rules and all applicable ARB regulations.
