File Keepers LLC Case Settles for $23,100
In November 2013, File Keepers LLC agreed to pay a penalty of $23,100.00 for violating air quality regulations: $17,325.00 will be paid to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $5,775.00 will be paid to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program.
An investigation by CARB showed that File Keepers LLC failed to properly self-inspect their diesel trucks to assure the trucks met state smoke emission standards as required by the Periodic Smoke Inspection Program (PSIP); and failed to ensure all engines of their fleet vehicles had a properly affixed Emission Control Label (ECL); failed to meet PM BACT requirements for 1996 through 1999 engine model years by January 1, 2012 and requirements for 2000 through 2004 engine model years by January 1, 2013 as required by the Statewide Truck & Bus Regulation (STB). ARB documented violations as they related to PSIP, ECL Program, and STB. To settle the case, File Keepers LLC agreed to the $23,100.00 penalty and to comply with PSIP, ECL, STB, and other ARB programs.
