Ferguson Enterprises, Inc. Case Settles for $87,500
The facility of Ferguson Enterprises, Inc. (Ferguson) at the Port of Stockton was inspected on August 9, 2012 for compliance with the Cargo Handling Equipment regulation. The inspection indicated that there were 5 pieces of equipment out of compliance. On February 22, 2013 a Notice of Violation was issued to Ferguson for 5 violations to Title 13 CCR §2479. Since the NOV was received Ferguson retired and replaced all the CHE in violation. They are now in compliance with the CHE regulation. A Settlement Agreement was mailed February 26, 2014 indicating a total penalty in this case of $87,500. This case was settled on March 28, 2014 when the signed Settlement Agreement and a check for $87,500 in penalties for 5 violations to Title 13 CCR §2479 was received. The Settlement Agreement was signed by Ellen M. Peter, Chief Counsel, Air Resources Board on April 18, 2014.
