Fenix Marine Services Settles Cargo Handling Equipment Violations for $87,750.00
In August 2019, the California Air Resources Board (CARB) settled a case with Fenix Marine Services (FMS), in Los Angeles, California, in the amount of $87,750.00. The penalty was incurred for violating the Cargo Handling Equipment (CHE) Regulation. The violations were discovered during a routine inspection of CHE at the FMS Terminal in the Port of Los Angeles, by CARB staff. An investigation by CARB showed that FMS failed to perform annual opacity tests on 222 pieces of CHE as required by the CHE Regulation in 2017 and 2018. The penalty paid in this case was $395.27 per violation for 222 pieces of CHE. To settle the case, FMS agreed to the $87,750.00 penalty and to comply with CARB’s CHE Regulation.
