Provenza Floors, Incorporated Case Settles for $26,000
On October 18, 2018, a case was settled with Provenza Floors, Incorporated (Tustin, California) for selling, supplying, and offering for sale in California non-compliant laminate flooring that contained medium density fiberboard. The products, Provenza Caribbean Sea Nevis and Provenza Harmony Mirage, contained formaldehyde emissions above the limits set forth in the Airborne Toxic Control Measure (ATCM) to Reduce Formaldehyde Emissions from Composite Wood Products that has been in effect since January 1, 2009 (title 17 California Code of Regulations sections 93120 through 93120.12). In addition, Provenza Floors, Incorporated was found in violation of not taking reasonable and prudent precautions, which includes the purchase and sale of flooring product in California that were not labeled in accordance with the ATCM requirements. Provenza Floors, Incorporated has discontinued the sale of the non-compliant products and has agreed to pay $26,000.00 to settle this case.
