Hawk Transportation Inc. Settles For $27,600
In December 2021, the California Air Resources Board (CARB) reached a settlement with Hawk Transportation Inc., located in Fontana, California,in the amount of $27,600 for violating CARB’s air quality regulations. The full settlement amount of $27,600 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality.
An investigation by CARB staff showed that Hawk Transportation Inc. failed to meet the applicable smoke testing requirements for 30 heavy-duty diesel vehicles in their fleet for 2 years. The staff documented violations as they related to the Periodic Smoke Inspection Program (PSIP) (Cal. Code Regs., tit. 13, § 2190 et seq.). Specifically, the investigation revealed 24 PSIP violations in 2018, and 30 PSIP violations in 2019. Hawk Transportation Inc. violated the Heavy-duty Vehicle Inspection Program (HDVIP) Regulation (Cal. Code Regs., tit. 13, §§ 2180-2189) by having defective emission control components for its fleet of heavy-duty vehicles for 2021. This resulted in two violations, as outlined in citation T01093021001GP and T01101321001GP. To settle the case, Hawk Transportation Inc. agreed to the penalty of $500 per violation for the PSIP violation, and to two citations at $300 per violation, for a total of $27,600.
Terms of the settlement include a requirement that Hawk Transportation Inc. attend a smoke-test training course, submit PSIP tests for the entire applicable fleet for calendar years 2020 and 2021, and comply with PSIP, HDVIP and other CARB regulations going forward.
