Empire Tanker Case Settles for $50,000
In December 2018, Empire Tanker (Bloomington, California) settles case with the California Air Resources Board (CARB) for a total penalty of $50,000.
Empire Tanker violated the Certification of Vapor Recovery Systems for Cargo Tank procedures as established by 17 CCR § 94014, CP 204, & TP 204.1. Empire Tanker agreed to the per unit penalty of $25,000 for a total of $50,000 with $45,000 suspended providing Empire Tanker complies with the terms set forth in the settlement agreement.
In November of 2017, CARB inspectors witnessed an Annual Cargo Tank Certification conducted by Empire Tanker. Inspectors observed and documented two cargo tanks being intentionally purged and vented of gasoline vapors directly into the atmosphere.
Empire Tanker has permanently removed two fans used for purging vapors and has agreed not to violate the Certification and Testing procedures as established by H&SC § 41962 et seq., and 17 CCR § 94014 et seq., including CP-204 and TP-204.1.
