Emmett’s Excavation Incorporated Case Settles for $4,000
Emmett’s Excavation Incorporated will pay $4,000.00 in penalties for violating air quality regulations: $3,000.00 will go to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $1,000.00 will go to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program. This settlement was reached in August 2016.
An investigation by the Air Resources Board (ARB) showed that Emmett’s Excavation Incorporated failed to notify ARB within 30 days of adding 5 of their off-road vehicles into their fleet and failed to properly self-inspect their diesel trucks to assure the trucks met state smoke emission standards. ARB documented violations as they related to the Periodic Smoke Inspection Program (PSIP) and the Off-Road Diesel Vehicle (ORDV) Regulation. To settle the case, Emmett’s Excavation Incorporated agreed to the $4,000.00 penalty and to comply with the PSIP and ORDV programs.
