Earthworks Paving Contractors, Inc. Case Settles for $8,000
Earthworks Paving Contractors, Inc. paid $8,000.00 in penalties for violating air quality regulations: $6,000.00 went to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $2,000.00 went to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology program. This settlement was reached in July 2015.
An investigation by the Air Resources Board (ARB) showed that Earthworks Paving Contractors, Inc. failed to bring one of their diesel engines into compliance with the applicable in-use performance standards and failed to report all vehicles with engines utilizing the NOx Exempt Areas compliance option. Earthworks Paving Contractors, Inc. also failed to properly self-inspect their diesel trucks to assure the trucks met state smoke emission standards. ARB documented violations as they related to the Periodic Smoke Inspection Program (PSIP) and the Truck and Bus (T&B) Regulation. To settle the case, Earthworks Paving Contractors, Inc. agreed to the $8,000.00 penalty and to comply with PSIP,T&B, and other ARB programs.
