Cummins, Inc. Agrees to Pay $2.1 Million in Penalties Under a Settlement Agreement Resolving Violations Of The Clean Air Act-- $420,000 Paid to ARB
The Air Resources Board (ARB), the United States Environmental Protection Agency (EPA), and the Department of Justice settled violations of the Clean Air Act against Cummins, Inc for shipping diesel engines without exhaust after-treatment devices (ATDs) resulting in engines identified as having the incorrect ATD installed. Cummins has agreed to recall the non-conforming engines and install the correct ATD. EPA estimates that Cummins actions resulted in excess tons of NOx and HC emissions, and tons of PM emissions over the lifetime of the non-conforming engines. Cummins will mitigate the effects of the excess emissions by permanently retiring emissions credits equal to the excess tons. $420,000 of the penalty amount will go to ARB’s Air Pollution Control Fund.
