CMA CGM S.A., Settles Ocean-Going Vessels Fuels Regulation Violation For $165,920.00
In April 7, 2020, CMA CGM S.A., of Marseille, France, reached a settlement with the California Air Resources Board (CARB), agreeing to pay penalties of $165,920.00 for violating the Ocean-Going Vessels Fuels Regulation. The violations were discovered during a routine inspection by CARB staff. CARB investigation showed that the CMA CGM S.A. vessel, CMA CGM A. Lincoln, failed to operate on compliant fuel upon entry into Regulated California Waters in 2018. CARB alleged twenty-two days and fifty-two hours of violations for a penalty of $6,100 per day, and $610 per hour.
CMA CGM S.A. took prompt action after being notified of these violations and, under CARB’s supervision, began operating in a compliant fashion under CARB’s regulations.
Under the terms of the Settlement Agreement, CMA CGM S.A. agreed to fund the Air Filtration Systems in Schools-Oakland, Supplemental Environmental Project. To this end, CMA CGM S.A. paid $82,960 to IQAir Foundation, and $82,960 to the Air Pollution Control Fund.
