City of Calexico Case Settles for $10,000
State Law establishes the Asbestos National Emissions Standard for Hazardous Air Pollutants as Airborne Toxic Control Measure (Asbestos ATCM) enforceable by Air Resources Board (ARB). The Asbestos ATCM requires the owner(s) or operator(s) of demolition or renovation activities to thoroughly inspect for the presence of asbestos, and to provide written notification of the intention to demolish or renovate a regulated facility ten (10) working days before demolition or renovation begins.
An investigation by ARB staff showed that the City of Calexico failed to thoroughly inspect for the presence of asbestos and failed to properly notify ARB before demolishing a structure in Imperial County. To settle the case, the City of Calexico agreed to the $10,000 penalty and agreed to comply with all asbestos requirements before any demolition or renovation. The City of Calexico also agreed to revise its Building Department Policies to ensure that all projects approved by the City comply with the Asbestos ATCM. This settlement was reached in June 2016.
