Big Lots Stores, Inc. and PNS Stores, Inc. Case Settles for $250,000
On June 2, 2016, a case was settled with Big Lots Stores, Inc. and PNS Stores, Inc. (collectively refer to as Big Lots) for selling four types of non-compliant Automotive Windshield Washer Fluid products in its California stores. The four products, Splash Windshield Washer Fluid -20 °F, Splash All Season 3‑in‑1 ‑25 °F Premium Washer Fluid, Zecol Power Blast Windshield Washer Fluid ‑20 °F, and Zecol Power Blast Windshield Washer Fluid -20 °F, contained concentrations of Volatile Organic Compounds (VOC) exceeding the one percent by weight VOC limit for the category in the Pre-Mixed non-Type “A” areas, as well as the 25 percent State standard in the Type “A” areas of the Automotive Windshield Washer Fluid category. The total excess VOC emissions from the sales of these products between September 2013 and November 2014 were approximately 5.0 tons. Due to a continuous violation in the Automotive Windshield Washer Fluid category by Big Lots, the total penalty in this case was settled at $250,000.00 which represents approximately $49,000 per ton plus ARB’s investigative cost.
