Asbury Carbons, Incorporated Settles For $3,000
In May 2019, a case was settled with Asbury Carbons, Incorporated (Asbury, New Jersey) for selling a Multi-Purpose Lubricant products into California that contained concentrations of volatile organic compounds that exceeded the standard specified in the Consumer Product Regulation, title 17 California Code of Regulations section 94509(a). These products contained concentrations of toxic air contaminants that are prohibited in the standards specified in the 17 CCR section 94509(m)(1) and did not properly display the date of manufacture as specified in 17 CCR section 94512(b). Asbury Carbons, Incorporated paid $3,000 in penalties for three days of violation (the day the product was purchased by CARB, the day it was supplied to the retailer, and the day it was manufactured for sale). To come into compliance, Asbury Carbons, Incorporated has reformulated the product and no longer offers the product as a Multi-purpose Lubricant for commerce in California.
