American Transportation Sightseeing Case Settles for $10,000
American Transportation Sightseeing, based in Long Beach, California will pay $10,000.00 in penalties for violating air quality regulations: $10,000.00 will go to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality. This settlement was executed on April 2018.
This case was initiated based on the SMART audit streamlined process, which indicated the company was out of compliance with CARB’s air regulations. The investigation of American Transportation Sightseeing revealed they failed to follow the engine model year compliance schedule of the Truck and Bus (TB) Regulation (13 CCR § 2025(g)), which requires owners of diesel vehicles with a GVWR greater than 26,000 lbs. (heavier vehicles) meet PM Best Available Control Technology (BACT) requirements for all 1996-1999 model year engines by January 1, 2012; all 2000-2004 model year engines by January 1, 2013, and to upgrade to a 2010 model year emissions equivalent engine for all 1994 and older model year engines by January 1, 2016.
The penalty obtained for the TB violations involved in this case for failure to meet the requirements of the engine model year compliance schedule for heavier vehicles is $10,000 or $1,250 per vehicle per violation for 8 vehicles. CARB documented the violations as related to the TB Regulation. To settle the case, American Transportation Sightseeing agreed to the $10,000 penalty and to comply with TB and other CARB programs.
