Tri-state Well Drilling and Pumps, Inc. Settles For $10,000
In May 2024, the California Air Resources Board (CARB) reached a settlement with Tri-state Well Drilling and Pumps, Inc. (Tri-State) for violations of the Regulation to Reduce Emissions of Diesel Particulate Matter, Oxides of Nitrogen and Other Criteria Pollutants, from In-Use Heavy-Duty Diesel-Fueled Vehicles (Truck and Bus Regulation), as codified in the California Code of Regulations, title 13, section 2025.
An investigation was conducted by CARB staff showed that Tri-state failed to meet Particulate Matter (PM) Best Available Control Technology (BACT) requirements of the Engine Model Year Compliance Schedule for two diesel vehicles with a Gross Vehicle Weight Rating (GVWR) greater than 26,000 lbs. (heavier vehicles), as they relate to the Truck and Bus Regulation (Cal. Code Regs., tit. 13, § 2025).
To settle the case, Tri-state agreed to the penalty of $5,000 per Truck and Bus Regulation violations for a total of $10,000. Tri-state fully cooperated with CARB to resolve this matter. The total penalty amount will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality. Terms of the settlement include a requirement for Tri-State to maintain reporting, record keeping and mileage requirements of the Low Use Exemption.
