Sunrise Growers, Inc. Case Settles for $12,375
In March 2015, Sunrise Growers, Inc. (Sunrise Growers) paid $12,375.00 for non-compliance with Air Resources Board (ARB) regulations: $7,032.00 was paid to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $2,343.00 was paid to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology program, and the return of Moyer funds of $3,000.00 was paid to the San Diego Air Pollution Control District for non-compliance with ARB regulations, as required by the Carl Moyer contract.
An investigation by the ARB showed that Sunrise Growers (1) failed to timely report all required information for all vehicles in the fleet for which they elected to utilize the compliance options/credits/provisions of the Statewide Truck & Bus (STB) Regulation; (2) and to comply with the Periodic Smoke Inspection Program (PSIP). ARB documented violations as they related to the STB Regulation and PSIP. To settle the case, Sunrise Growers agreed to the $9,375.00 penalty, the $3,000.00 return of Moyer funds, and to comply with the PSIP, STB, and other ARB programs. Sunrise Growers does not have a history of past violations.
