Shaffs Construction Case Settles for $6,100
Shaffs Construction will pay $6,100.00 in penalties for violating air quality regulations: $4,575.00 will go to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $1,525.00 will go to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program. This settlement was reached in September 2016.
An investigation by the Air Resources Board (ARB) showed that Shaffs Construction failed to (1) bring one of their on-road vehicles into compliance with the applicable diesel particulate matter best available control technology requirements; (2) properly self-inspect their diesel trucks to assure the trucks met state smoke emission standards; (3) report changes in its off-road fleet per the reporting requirements set forth in the In-Use Off-Road Diesel-Fuel Fleets (Off-Road) Regulation. ARB documented violations as they related to the Truck and Bus (TB) Regulation, the Periodic Smoke Inspection Program (PSIP), and the Off-Road Regulation. To settle the case, Shaffs Construction agreed to the $6,100.00 penalty and to comply with PSIP, Off-Road, TB, and other ARB programs
