Rust and Sons Trucking, Inc. Case Settles for $22,000
Rust and Sons Trucking, Inc. will pay $22,000.00 in penalties for violating air quality regulations: $16,500.00 will go to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $5,500.00 will go to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program. This settlement was reached in February 2016.
An investigation by the Air Resources Board (ARB) showed that Rust and Sons Trucking failed to bring thirteen of their heavy-duty diesel trucks into compliance with the diesel particulate matter best available control technology. Rust and Sons Trucking also failed to have a legible Emission Control Label affixed to the engine of one of its trucks. ARB documented violations as they related to the Truck and Bus Regulation and Emission Control Label Program. To settle the case, Rust and Sons Trucking agreed to the $22,000.00 penalty and to comply with the Truck and Bus Regulation, Emission Control Label Program and other applicable ARB regulations.
