Rogue Jet Boatworks, Inc. Settles For $72,500
In May 2021, Rogue Jet Boatworks, Inc. (ROGUE) of White City, Oregon settled its case with the California Air Resources Board (CARB) for manufacturing for sale, advertising, offering for sale, selling, and delivery into California of noncertified Spark-Ignition Marine Watercraft (SIMW). In 2018, CARB inspected ROGUE at an exposition, issued Notice of Violation (NOV) #2451 for 4 vessels with noncompliant Spark-Ignited Marine Watercraft Evaporative Systems, and initiated an investigation that found 14 additional noncompliant vessels were sold into California in violation of California Code of Regulations, title 13, section 2850 (13 CCR § 2850) et seq.
ROGUE entered into a settlement agreement with CARB and agreed to pay a total penalty amount of $72,500 or $4,027.78 per unit, for the uncertified vessels. The penalty distribution will allocate $36,250 to CARB’s Air Pollution Control Fund and $36,250 to a Supplemental Environmental Project (SEP), Placer County Community Based SEP Phase 2.
ROGUE cooperated with the investigation, submitted requested documentation, provided proof of removal, has a history of compliance, obtained SIMW Evaporative System certification and received a CARB Executive Order (EO) to avoid future violations, and assisted in the mutual settlement of this case.
