Rite Aid Corporation Case Settles for $410,000
On April 26, 2012, Rite Aid Corporation settled a repeat violation case involving sales of non-complying windshield washer fluid products subject to the California Consumer Products regulation. Between March 2007 and continuing through at least April 2009, Rite Aid offered for sale and sold in non-type A areas at least 794 gallons of pre-mixed windshield washer fluid with a volatile organic compound (VOC) content that did not meet the one percent limit for that product category. During ARB investigations, Rite Aid failed to respond to written requests for information for several months.
These violations came directly on the heels of a previous series of violations that were settled on January 8, 2009 for $340,000 involving the same product category. Due to the continuing nature of the violations, a civil complaint was filed in Sacramento County on August 19, 2010. Rite Aid Corporation and the State of California agreed to a $410,000 stipulated settlement during mediation which was executed by the County of Sacramento State Superior Court on May 4, 2012. Rite Aid will also provide ARB staff with reports detailing their windshield washer fluid product sales, and make notations on their national print ads that feature high-VOC windshield washer fluid products that these products are not legal for sale in non-Type areas of California.
