Redding Yamaha Case Settles for $20,000
In August 2011, the Air Resources Board (ARB) reached a settlement with Redding Yamaha SeaDoo located in Redding, California that included a twenty thousand dollar ($20,000) penalty to the California Air Pollution Fund for offering for sale and/or selling four Aprilia motorcycles that were not certified for sale or use in California. Fifteen thousand two hundred dollars ($15,200) of the penalty was stayed as long as certain conditions are met. An investigation by the ARB showed that sometime before December 2008 Redding Yamaha SeaDoo received at least three new 2008 and one new 2009 Aprilia motorcycles from the manufacturer that had been certified by ARB. Redding Yamaha SeaDoo removed all of the emission control equipment from three of these certified motorcycles and ultimately sold and registered them to California residents. Redding Yamaha SeaDoo also modified a new 2008 Aprilia motorcycle by removing all of the emission control equipment and reprograming the computer and then offered it for sale on their showroom floor. The modifications made to all of these new motorcycles rendered them uncertified and illegal for sale in California and were in violation of Health and Safety Code sections 43151 through 43153. Redding Yamaha SeaDoo restored the one motorcycle that was on its showroom floor to its original certified condition. The case settled in August 2011, for Twenty Thousand Dollars ($20,000).
