Pasha Hawaii Holdings LLC Settles For $315,000
In August 2026, the California Air Resources Board (CARB) reached a settlement with Pasha Hawaii Holdings LLC (Pasha), with its principal location in National City, California, for the company’s violation of the Control Measure for Ocean-Going Vessels At Berth (At Berth Regulation), as codified in California Code of Regulations, title 17, sections 93130-93130.22
A records audit of visit information reports conducted by CARB Enforcement Division staff showed that Pasha failed to meet the vessel operator requirements as set forth in the At Berth Regulation during 2023 and 2024.
To settle the case, Pasha agreed to the penalties of $22,000 per day for 14 emissions related violations, and $1,000 for each of 7 reporting related violations. Pasha’s total settlement amount is $315,000. The civil penalty amount of $157,500 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality.
Pasha elected to fund a Supplemental Environmental Project (SEP) with the remaining amount of $157,500, entitled Placer County Community Based SEP Phase 2, with Placer County Air Pollution Control District. The purpose of the SEP is to install and maintain high-performance air filtration systems in schools located in communities disproportionately impacted by toxic air contaminants. The schools listed in this SEP are near important sources of air pollution in Placer County, especially rail yards and heavily trafficked roadways. Installation of air filtration systems in schools will target fine and ultrafine particulate matter, black carbon found in locomotives and trucks, and other toxic air contaminants.
Terms of the settlement include a requirement for Pasha to comply with all other CARB regulations going forward. Pasha worked cooperatively with CARB staff to quickly resolve this matter and implemented additional measures to reduce the potential of any future violations.
