Pacific Express Case Settles for $5,000
Pacific Express paid $5,000.00 in penalties for violating air quality regulations: $3,750.00 went to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $1,250.00 went to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program. This settlement was reached in June 2016.
An investigation by the Air Resources Board (ARB) showed that Pacific Express failed to bring one of their Transport Refrigeration Unit (TRU) into compliance with the applicable in-use performance standards and failed to properly self-inspect their diesel trucks to assure the trucks met state smoke emission standards. ARB documented violations as they related to the Periodic Smoke Inspection Program (PSIP) and the TRU Airborne Toxic Control Measure. To settle the case, Pacific Express agreed to the $5,000.00 penalty and to comply with PSIP, TRU, and other ARB programs.
