A. Oseguara Company, Inc. Case Settles for $102,475
In May 2014, A. Oseguera Co., Inc. paid $102,475.00 in penalties for violating air quality regulations: $76,857.00 went to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $25,618.00 went to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program.
An investigation by the Air Resources Board (ARB) showed that A. Oseguera Co., Inc. failed to (1) properly self-inspect their diesel trucks and buses to assure the vehicles met state smoke emission standards; (2) meet requirements of the Statewide Truck and Bus regulation’s (STB) Engine Model Year Compliance schedule; (3) register their Transport Refrigeration Units (TRUs) in the ARBER system; (4) meet the in-use performance standards of the TRU Air Toxic Control Measure (ATCM); (5) properly affix the ARB IDN to both sides of the TRUs in their fleet; and, (6) replace Emission Control Labels (ECL) as required. ARB documented violations as they related to STB, the Periodic Smoke Inspection Program (PSIP); the TRU ATCM; and, the ECL program. To settle the case, A. Oseguera Co., Inc. agreed to the $102,475.00 penalty and to comply with the PSIP, TRU, STB and ECL programs.
