Nissan of North America Inc. Settles For $7,500
In January 2022 the California Air Resources Board (CARB) reached a settlement with Nissan of North America Inc. (Nissan), with its principal location in Franklin, Tennessee, in the amount of $7,500 for violating CARB’s air quality regulations. Of the total amount, $3,750 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality. The remaining amount of $3,750 will fund the Supplemental Environment Project (SEP) entitled “Marine Vessel Speed Reduction Incentive Program Phase 2” with the Ventura County Air Pollution Control District. This SEP involves implementing a vessel speed reduction (VSR) incentive program, which provides financial and public relations incentives for owner/operators of ocean-going cargo vessels to slow down in the VSR zones during peak whale and ozone seasons.
CARB staff’s review of Nissan documents revealed that the company introduced three non-certified flex fuel Frontier vehicles into commerce in California. CARB documented the violations as they related to Cal. Code Regs., tit. 13, § 43150 et seq. To settle the case, Nissan agreed to the penalty of $2,500 per non-certified vehicle for a total of $7,500, which is a 90 percent plus reduction in penalty for self-disclosing the violations.
