New Flyer America and Motor Coach Industries, Inc. Settle For $970,000
In June 2024, the California Air Resources Board (CARB) reached a settlement with New Flyer America (NFA) and Motor Coach Industries, Inc. (MCI) with their principal locations in Saint Cloud, Minnesota and Des Plaines, Illinois respectively, for the companies’ violation of CARB’s air quality regulations in the Airborne Toxic Control Measure to Limit Diesel-Fueled Commercial Motor Vehicle Idling (ATCM), under California Code of Regulations, title 13, section 2458.
NFA and MCI voluntarily disclosed the potential violations they discovered to CARB. A subsequent investigation by CARB’s Enforcement Division staff confirmed and documented that NFA and MCI manufactured for sale, sold, and introduced into commerce in California, new heavy-duty buses equipped with fuel-fired heaters that were not certified by CARB.
To settle the case, NFA and MCI agreed to the penalty of $2,500 per violation for a total penalty amount of $970,000. The full civil penalty amount of $970,000 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality.
Terms of the settlement include a requirement for NFA and MCI to comply with all CARB regulations going forward. NFA and MCI voluntarily self-disclosed the violations and fully cooperated with CARB to resolve the matter.
