Mitch Brown Construction, Inc. Case Settles for $16,225
Mitch Brown Construction, Inc. will pay $16,225.00 in penalties for violating air quality regulations: $12,169.00 will go to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $4,056.00 will go to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program. This settlement was reached in February 2016.
An investigation by the Air Resources Board (ARB) showed that Mitch Brown Construction, Inc. failed to bring their fleet into compliance with the Truck and Bus regulation, failed to properly report their off-road vehicles, and failed to properly self-inspect their diesel trucks to assure the trucks met state smoke emission standards. ARB documented violations as they related to the Periodic Smoke Inspection Program (PSIP), the In-Use Off-Road Diesel Vehicle Regulation (ORE), and the Truck and Bus (TB) Regulation. To settle the case, Mitch Brown Construction, Inc. agreed to the $16,225.00 penalty and to comply with PSIP, ORE, TB Regulation, and other ARB programs.
