Midwest Can Company, LLC Settles For $295,000
In June 2025, the California Air Resources Board (CARB) reached a settlement with Midwest Can Company, LLC (MDC), a portable fuel container manufacturer located in Franklin Park, Illinois, for violations related to CARB’s Portable Fuel Containers and Spill-Proof Spouts Regulation (Portable Fuel Container Regulation) as codified in California Code of Regulations, title 13, sections 2467 et seq.
CARB conducted compliance testing of MDC’s portable fuel container systems (PFC) that were certified under CARB Executive Order G-16-001B. CARB alleges the PFCs failed to meet the diurnal performance specification of MDC’s certification requirements.
To settle the case, MDC agreed to the penalty of approximately $5.76 per unit of noncompliant PFC for a total penalty of $295,000. MDC elected to provide $147,500 to a Supplemental Environmental Project (SEP) entitled, The Bowl at Kenneth Hahn Revitalization: Implementation Phase I. The SEP proposes to revitalize The Bowl at Kenneth Hahn Park in Los Angeles by installing trees and native plants.
The civil penalty amount of $147,500 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality. MDC fully cooperated with CARB to resolve this matter and agrees to comply with all regulatory requirements.
