McWane, Inc., dba American Brass & Iron Foundry, Settles for $1,200,000
In June 2024, the California Air Resources Board (CARB) and the Bay Area Air Quality Management District (BAAQMD) reached a settlement with McWane, Inc. (McWane), individually and doing business as the American Brass & Iron Foundry (AB&I Foundry), with its principal location in Birmingham, Alabama, for violations of California Health and Safety Code section 41700, and BAAQMD Regulation 1-301.
McWane ceased all operations at AB&I Foundry in October 2022, and no longer conducts any business activities in the State of California that qualify as a major source of regulated emissions under the Federal Clean Air Act.
To settle the case, McWane agreed to the penalty of $1,200,000. Of the total amount, $540,000 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California’s air quality, and $60,000 will go to BAAQMD. The remaining amount of $600,000 will fund two Supplemental Environmental Projects (SEPs) in East Oakland. The Rose Foundation SEP will support the organization’s grant program, East Oakland Air Quality Fund, and provide grants to grassroot activists and local organizations to address crucial air quality concerns in East Oakland. The Roots Community Health Center SEP funding will add two respiratory clinics in East Oakland, expand their community outreach and home follow-up visits, and grow their pediatric asthma outreach through schools and youth programs in local communities. Their program, Breathe Oakland, aims to provide widespread screening of homeless individuals throughout Oakland, as well as ongoing medical care and self-management support for those diagnosed with a respiratory condition.
McWane fully cooperated with CARB and BAAQMD to resolve this matter.
