Malcom Smith Motorcycles Case Settles for $2,400
In August 2011, the Air Resources Board (ARB) reached a settlement with Malcom Smith Motorcycles located in Riverside, California that included a $2,400 penalty paid to the California Air Pollution Fund for offering for sale and selling two Aprilia motorcycles that were not certified for sale or use in California.
An investigation by the ARB showed that sometime before January 2010 Malcom Smith Motorcycles recieved at least two new 2009 Aprilia motorcycles from the manufacturer that had been certified by ARB. Malcom Smith Motorcycles removed all of the emission control equipment from two of these certified motorcycles and ultimately sold them and registered both to California residents. These motorcycles were illegal for sale or use in California and were in violation of Health and Safety Code 43151 through 43153. The case settled in August 2011 for $2,400.
