Kmart Corporation Case Settles for $34,000
On October 2, 2014, a Consumer Products case was settled with Kmart Corporation for selling and/or supplying several non-compliant Windshield Washer Fluid products in both Type-“A” and non Type-“A” areas of California, as specified in Title 17, CCR, section 94509(a). An additional violation for failing to provide records within 90 days as specified in Title 17, CCR, section 94513(a) was also settled. By exceeding their applicable VOC compound content limits, these products contributed 0.34 tons of excess VOC emissions to California’s air. Since this was Kmart’s second VOC violation for selling non-compliant Windshield Washer Fluid products, enhanced penalties were sought. Kmart Corporation paid $34,000 to settle this case.
