Huss, Inc. Case Settles for $8,250.00
Huss, Inc. paid $8,250 in penalties ($6,187.50 went to the California Air Pollution Control Fund and $2,062.50 to the Peralta Community College District for distribution to participating California Council on Diesel Education and Technology (CCDET) colleges. This settlement was reached in September 2012.
An investigation by the Air Resources Board (ARB) showed that Huss, Inc. failed to comply with the applicable Executive Order (EO) and the Verification Procedure by installing a Huss FS-MK Series Diesel Particulate Filter after removing the original equipment diesel oxidation catalyst and mislabeling an On-Road application as an Off-Road application. The EO issued by ARB for the Huss FS-MK Series Diesel Particulate Filter requires that if the engine is certified with an oxidation catalyst from the original equipment manufacturer, the original equipment diesel oxidation catalyst must be left in place and not removed. The Verification Procedure system labeling (California Code of Regulations, title 13, Section 2706 (j)) requires to include the verified application (on-road versus off-road) to be included in the Diesel Emission Control Strategy family name. To settle the case, Huss, Inc. agreed to the $8,250 penalty and to comply with the VC Section 27156, the Aftermarket Parts Regulations, the Verification Procedure and the applicable EO.
