Gemini Coatings, Incorporated Settles For $145,000
In March 2021, the California Air Resources Board and Gemini Coatings, Incorporated (Gemini) of El Reno, Oklahoma, reached a settlement agreement in the amount $145,000. Gemini sold, supplied, offered for sale, and/or manufactured for sale in California, paint thinners and a multi-purpose solvent containing concentrations of volatile organic compounds (VOC) that exceeded the standards specified in California Code of Regulations, title 17, (17 CCR) section 94509(a). The company also sold, supplied, offered for sale, and/or manufactured for use in California, a floral coating that exceeded the reactivity limit specified in 17 CCR section 94522(a). In addition, the products did not meet labeling requirements. The violations resulted in 11.97 tons of excess VOC and ozone emissions. To come into compliance, Gemini ceased sales of noncompliant products, enhanced its sales identification program, and modified other products to be compliant with regulations.
