Zero Emission Space and Water Heater

I live near Richmond where Chevron is allowed to pollute poor communities if they pay into a fund. I’ve participated in their climate change events where thy have lots of free swag and some electric vehicles. They stand out there on the concrete jungle breathing fumes from the refinery while handing out reusable mugs. As if cutting down on plastic will nullify the smoke billowing out of the refinery.

This seems like another cap and trade boondoggle to me. No doubt you would do so much better were it not for the outside pressure you get. I know you work hard and have to satisfy so many different factions. But this is not enough and I hope you will push back on the people pressuring you to take a slower approach.

I strongly favor the policy of the Bay Area Air District requiring that newly installed water and space heaters be zero NOx after specified dates with common sense exceptions.

Your state standard does not properly align with state climate goals as outlined in the 2022 Scoping Plan. It falls far short of eliminating air pollution as needed to match targets of the State Implementation Plan (SIP)

CARB's analysis overstates the need for electrical service upsizing associated with installing non-polluting devices

My hope is that you stick with the zero NOx rule. If not I propose the following changes:

1. The start date should be accelerated as the proposed 2030 date allows for preventable emissions and pollution in years prior

2. The emissive sales limits should ramp down much faster and to a level that accounts for only the most challenging situations.

3. The credit system should be restructured such that it does not undermine the emission reduction goals of the regulation

4. Appropriate penalties for non-compliance are critical.

We cannot put in place another cap and trade and expect different results. This will be another
policy that subjects communities of color and poor people to more toxic air. I hope we can somehow avoid past mistakes.
