FMF Racing Case Settles for $79,500
FMF Racing (FMF) is a manufacturer of motorcycle exhaust, race bike parts and aftermarket motorcycle accessories. FMF sold, offered for sale, and/or advertised, in California, aftermarket critical emission control parts for motorcycles. These parts were intended for use with, or as a part of, a required motor vehicle pollution control device or system that alters or modifies the original design or performance of that motor vehicle pollution control device or system. FMF instituted a compliance plan to ensure that its dealers, distributors, and customers understand what aftermarket critical emission control parts are legal or illegal for sale in specific applications. This includes in part, specific warnings and disclaimers on its website, product packaging, invoices and instructional material. FMF also implemented an affidavit to be signed by each end-user indicating the consumer’s understanding and agreement that purchased parts are to be used only on a racing vehicle.
The case was settled in March 2014 with FMF agreeing to pay $79,500 to the California Air Pollution Control Fund.
