West Central Produce, Inc. Case Settles for $23,400
West Central Produce, Inc. will pay $23,400.00 in penalties for violating air quality regulations: $17,550.00 will go to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $5,850.00 will go to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology program. This settlement was reached in February 2016.
An investigation by the Air Resources Board (ARB) showed that West Central Produce, Inc. failed to properly self-inspect its diesel trucks as required by Periodic Smoke Inspection Program (PSIP), properly affix Emission Control Labels (ECL) on engines in their fleet vehicles, bring Transport Refrigeration Units (TRU) into compliance with the in-use performance standards, update their TRU Operator Report within 30 days resulting in false information, meet particulate matter best available control technology requirements for their Truck and Bus fleet, and include the Disclosure of Regulation Applicability on the bill of sales. ARB documented violations as they related to PSIP, the TRU Airborne Toxic Control Measure, ECL program and the Truck and Bus (TB) regulation. To settle the case, West Central Produce, Inc. agreed to the $23,400.00 penalty and to comply with PSIP, ECL, TRU, TB, and other ARB programs.
