Tutor Perini Corporation and O& G Industries, Inc. a Joint Venture Case Settles for $9,000

Tutor Perini Corporation and O & G Industries, Inc. a Joint Venture (TPCOGI JV) self-disclosed violations of the In-Use Off-Road Regulation to the California Air Resources Board.  TPCOGI JV added nine banned engines to their fleet.  These engines were the cleanest Mine Safety Health Administration-approved engines available or technically feasible that could be used in the types of equipment needed to perform work in areas classified as “gassy” by the California Department of Industrial Relations Division of Occupational Safety and Health.  To settle the case, TPCOGI JV agreed to mitigate all emissions from these violations. The emissions reductions in total will be greater than the noncompliance would generate.  If TPCOGI JV does not comply with the terms set forth in the settlement agreement, TPCOGI JV will pay $9,000.00 in penalties, or $1,000 per unit, for violating air quality regulations.  This settlement was reached in August 2018.
