Smartway Express Incorporated Case Settles for $22,125.00
On July 2, 2013, Smartway Express Incorporated (SEI) agreed to pay $22,125.00 in penalties for violating air quality regulations: $16,593.75 will go to the California Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $5,531.25 went to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology program.
The Air Resources Board (ARB) investigation of SEI was initiated when an informer identified the company as a violator of the Transport Refrigeration Unit (TRU) regulation. Based on the information provided during the investigation, it was determined that SEI failed to comply with the Periodic Smoke Inspection Program (PSIP), and the TRU regulation. To settle the case, SEI agreed to the $22,125.00 penalty and to comply with the PSIP, TRU programs.
