An air district may request CARB approval of a project that varies from the requirements of the Lower-Emission School Bus Program (LESBP) Guidelines on a case-by-case basis. These decisions are posted to assist districts in preparing a case-by-case request. These decisions are project-specific and may not be applicable to other projects. Districts should seek the guidance of CARB staff for each determination that is not addressed in the LESBP Guidelines and advisories/mailouts. Requests and their determinations are listed below in chronological order through the year 2010.
2024 Case-by-Case Determinations

Request: The air district is requesting a one-time exemption to allow LESB funding (AB923) for twenty-six (26) compressed natural gas school buses, owned and operated by ten (10) public school districts, to be funded at the project cost cap for school buses equipped with engines certified at the optional low NOx standards.

Determination:
Mail-Out #MSC 15-30 (Table 1) specifies the project cost cap for school bus replacement projects. For school buses with engines certified to optional low NOx standards (i.e., 0.1, 0.05, or 0.02 g/bhp-hr), the cost cap is $220,000. For school buses with engines that are not certified to these standards, the cost cap is $165,000.
In December 2021, ten (10) public school districts were awarded AB923 funds by the South Coast Air Quality Management District (AQMD) to replace their old diesel-powered school buses with new CNG school buses certified at optional low NOx standards through the Lower Emission School Bus Program. These school districts selected to purchase the Blue Bird T3RE CNG school bus as the replacement bus. Due to parts and supply chain delays, the school buses were delivered in between August 2023 and December 2023 and are now in operation by the school districts.
The manufacturer, Blue Bird, produces the T3RE CNG school buses equipped with the Cummins L9N engine. It was anticipated that the replacement school buses would be equipped with the 2022 model year L9N engine with the engine family NCEXH0540LDA that was certified to the optional 0.02 g/bhp-hr low NOx standard. However, effective with the 2023 model year, Cummins Westport stopped certifying engines to the optional 0.02 g/bhp-hr low NOx standard and has instead been certifying comparable engines to the 0.05 g/bhp-hr NOx standard. As a result, it was discovered that twenty-six (26) of the delivered school buses were equipped with the 2023 model year L9N engine that were certified to the less stringent NOx standard of 0.2 g/bhp-hr.
Neither the school districts nor the school bus manufacturer, Blue Bird, were aware of the certification discrepancy before the school buses were delivered and placed into operation.
Since the air district and school districts had no control over the change in engine, this case-by-case allows the Air District to make a one-time exception and allow the 26 school buses identified to be funded up to the $220,000 project cost cap for replacement school buses certified to the optional low NOx Standard. However, the District must not authorize future projects at the higher project cost cap for school buses equipped with engines certified at the optional Low NOx standard until such a time as Cummins Westport or another manufacturer produces an eligible engine certified by CARB to the 0.02 g/bhp-hr optional low NOx standard.

Request: Authorize a one-time flexibility for Rim of the World Unified School District for completing the installation of their alternative fueling infrastructure prior to full contract execution.
On May 4, 2018, the South Coast Air Quality Management District (SCAQMD) Governing Board approved funding for Rim of the World Unified School District under the Lower Emission School Bus Program (LESBP) which included funding for school buses and infrastructure. Shortly after the Board approval, the school district initiated work on their approved infrastructure, prior to the contract being fully executed as required in the LESBP guidelines. SCAQMD requests consideration of several extenuating circumstances: SCAQMD notified the school district of the approval without any warning that work should not begin until after the grant was signed; the school district staff were inexperienced with the grant process and misinterpreted the notification as approval to start construction; the location of the infrastructure project prevents or limits construction during winter months; and SCAQMD staff did not become aware of the school district's error until the school district submitted documentation for reimbursement on October 31, 2018. SCAQMD is well aware of the LESBP Guidelines, specifically under Appendix C, Section F. However, considering the circumstances outlined above, the District feels they should be afforded flexibility to allow the school district to maintain their eligibility for infrastructure funding.

Determination: Appendix C, Section F requires: The contract shall also require that no work may begin on the project until the contract is fully executed. This is to ensure that the air district and the CARB can fully enforce the contract during the life of the Lower-Emission School Bus Program-funded project.
CARB expects all air districts to follow the LESBP guidelines and ensure no work begins until award contracts are fully executed. In this case, due to the weather conditions at the location of the infrastructure project, the school district's options were to complete the project prior to full execution of the contract or wait for the following Spring/Summer to complete the project. Since a main goal of the Lower Emission School Bus Program is to reduce emissions from school buses as quickly as feasible and the additional wait time would be counter to that goal, approval is granted. This approval is granted under the condition that the school district provide SCAQMD a letter identifying their mistake, which SCAQMD will keep with the project file as documentation. While CARB understands the circumstances surrounding this project are unique, CARB expects air districts to take steps to prevent situations such as this from occurring in the future. Therefore, CARB recommends all air districts include a warning in all future award notifications that work should not commence until the contracts are signed by all parties.

Exemption #1
An exemption to the ‘within 18 months of tank expiration’ provision allows the air district to accept the request now and proceed with the processing of this application, allowing time to execute the grant agreement and replace the tanks before the earliest expiration date. The later expiring tanks will be replaced at the same time. This minimizes school bus down time, allowing the school buses to be out-of-service only once for the CNG tank replacement work. This exemption would not be needed if the air district waited until December 2016 to accept the request; however, they need 90 days to execute the grant agreement and three school buses have CNG tanks expiring in January 2017.

The new school bus was delivered with broken mirrors and, upon re-inspection, two more safety related issues were identified that took time to resolve. In addition, the old school bus was not driven after the new school bus was certified by the CHP. Finally, the old school bus was dismantled 66 days after delivery of the new bus.

Determination: The LESB Program Guidelines state that replacement buses must be delivered by April 1, 2014, and that the $100 per day Liquidated Damages for the late delivery of school buses must be applied to replacement buses delivered to the school district after April 1, 2014. The air district is requesting the delivery deadline for this contract to be changed from April 1, 2014, to April 15, 2014. The school bus vendor required placement of the purchase order by December 12, 2013, in order to ensure school bus delivery by April 1, 2014. This school bus is being co-funded by Lake County AQMD (administered by San Joaquin Valley APCD) with remaining Proposition 1B funds and North Coast Unified AQMD with local AB 923 funds.
The school district was not comfortable placing the school bus order until the North Coast Unified AQMD contract was executed as this contract represents the bulk of the funding. The contract execution was delayed due to absences of both school district and air district staff over the holidays. The North Coast Unified AQMD contract was executed on January 7, 2014. The school bus vendor has indicated that the replacement bus is now in the manufacturing process and is slated to be finished on March 15th. The bus will then have to be shipped/driven from Georgia to California. The bus vendor will then need time to pass inspections and continue with whatever work they need to do before delivery. The bus will be in California, but not to the school district before the April 1, 2014, deadline. The vendor has indicated that they can deliver the bus by April 15, 2014.

Determination: For Assembly Bill 923-funded compressed natural gas tank replacement projects, Mail-Out #MSC 11-37 requires school districts to provide documentation of tank expiration dates and serial numbers of tanks that are to be replaced. Mail-Out #MSC 11-37 allows tank replacement requests to be accepted by an air district within 18 months of their expiration dates – this allows the contract process to begin while preventing funding from being used to replace tanks that have a significant amount of useful life remaining. Documentation of tank expiration dates and serial numbers is often in the form of photos of the tanks’ labels.
At the time of application, the Napa Valley Unified School District was unable to provide clear photos of the old tank labels because there was not enough clearance for photography. Instead, the school district obtained the tank expiration dates and serial numbers through visual observation of the tank labels. Typically, in these situations, once the tanks are dropped and the tank labels are accessible for photography, the vendor takes photos of the old tank labels before disposing of the tanks. In this case, the vendor provided inadequate photo documentation of the tank labels, and the vendor later acknowledged this via email. In addition, the vendor indicated that the old tanks were disposed of directly after removal.

The school district, which is in Eureka, would like to replace Bus #10’s compressed natural gas tanks during July or August of 2013 – about four to five months before the bus will be 14 years old. In the request, the school district indicated that 1) the nearest vendor that is authorized to replace the compressed natural gas tanks is A-Z Bus Sales in Sacramento (a round trip from Eureka to Sacramento is approximately 600 miles); 2) A-Z Bus Sales is also the nearest vendor to repair and work on John Deere compressed natural gas engines; and 3) the John Deere engine in Bus #10 is experiencing mechanical issues and they plan to send it to Sacramento for service this summer. The school district estimates that it would save approximately $1,250 by having the compressed natural gas tanks replaced at the same time the engine is serviced during one trip from Eureka to Sacramento in July or August of 2013, as opposed to making two trips to Sacramento – one in July or August of 2013 to service the engine, and another one to replace the compressed natural gas tanks in 2014 after the bus is 14 years old.
The air district did not indicate that it will need the ability to proceed with this project prior to the bus reaching 14 years old in order to ensure tank replacement prior to the tank expiration date.

Having a spare filter minimizes the disruption to a school district’s normal fleet operation during filter maintenance intervals for a bus. The Lower-Emission School Bus Program Guidelines only allow funds to pay for one spare filter for up to 20 in-service retrofits. Because two different types of retrofit devices will be used, the school district would like to use Lower-Emission School Bus Program funds to purchase two spare filters -- one for the Donaldson LNF retrofit devices and one for the Donaldson LXF retrofit devices. The air district has remaining Proposition 1B funds due to projects dropping out and due to lower final invoice amounts as a result of the July 1, 2011 statewide one-percent decrease in the sales tax rate. Time is of the essence in these contracts for the purchase of new school buses to replace older, higher-polluting buses. Failure to timely deliver the new school buses will result in harm to the implementing agency, school districts, schoolchildren, and air quality in the affected school and air districts. Further, every day in which delivery of a new school bus has been delayed may result in additional costs to the implementing agency and school district to rent or lease an equivalent bus or otherwise mitigate the damages from the delay; such costs are definite but unquantifiable at the time of execution of the contract. Therefore, the parties acknowledge and agree to pay liquidated damages for failure to timely deliver the new school buses, as specified below:
For every day after May 4, 2012, in which a bus has not been delivered as specified in the contract, the school district shall be liable to the implementing agency for liquidated damages in the amount of $100 per day per bus purchased with funds from the Lower-Emission School Bus Program.
Furthermore, the contract/purchase agreement between the school district and the school bus distributor must include the following liquidated damages language:

- The air district must verify that the Non-Repairable Vehicle Certificate (DMV Form 488C) is on file with the Department of Motor Vehicles; and

Determination: The air district and school district had been discussing replacement and retrofit projects simultaneously. In early 2011, the air district approved a bus replacement project for the school district, but did not provide a contract at that time. Later, in March 2011, the air district sent an executed contract to retrofit two buses to the school district. At the same time, the air district and school district had been working to finalize the bus replacement project, in preparation for “going to contract.” When the school district received the executed retrofit contract and retrofit reimbursement paperwork from the air district, the school district mistook these documents as a replacement contract and accompanying reimbursement paperwork, and began work as if an executed replacement contract had been received. The school district proceeded to purchase a new replacement bus (VIN 1BABNBXA6CF284427) and to dismantle the old bus (VIN 1BABWCMAIAF050393).
The air district did not become aware of what had happened until May 2011, when the school district submitted a claim for payment packet for the new bus. The air district confirms that it has all documentation showing the eligibility of both the old bus and the new replacement bus, and that it will keep on file a letter from the school district that attests to their mistaken understanding of the contract and reimbursement paperwork that they received.
This approval is contingent upon the air district obtaining documentation that work on the replacement project did not begin before full execution of the retrofit contract that was mistaken by the school district as a replacement contract.
Finally, while the CARB understands the circumstances surrounding this project, the CARB considers this to be a very unusual request and will not approve similar case-by-case requests in the future.

Due to the extended delays of the Lower Emission School Bus Program, Grenada Unified initiated the process of ordering a new bus with a vendor in an effort to not lose their small school funds. This included a letter of intent to the vendor and the issuance of a Purchase Order by Grenada Unified School District prior to the restarting of the LESB program. Determination: The 2008 Guidelines allow ten percent of alternative-fueled replacement bus funding to be used for the refueling infrastructure when no local refueling site is available or the existing local refueling site is inadequate. This equates to about $14,000 per bus based on a $140,000 alternative-fuel replacement bus. These funds cannot be automatically set aside and may be used only if they are tied to funds spent for a specific bus purchased through the LESBP. Infrastructure costs may include, but are not limited to, labor, the concrete pad, the electrical infrastructure, and fuel tanks. Funding of leased projects is not discussed in the Guidelines.
CARB Action: Approved. Ten percent of the replacement bus cost can be used for leased infrastructure to support alternative-fueled buses purchased with AB 923 funds provided that the lease term is, at a minimum, the same as the contract term for the replacement bus supported by the infrastructure.

Determination: Rim of the World bus #29 is a 1976 Crown School Bus with a passenger capacity of 79 that is driven by the school district approximately 10,000 miles a year, and its current odometer reading is 350,298 miles. SB 88, which provides legislative direction for the expenditure of LESBP funds, requires that all pre-1977 MY buses be replaced first. In addition, Appendix F (List of Pre-1977 Model Year Public School Buses Still in Operation in California) of the 2010 LESBP Guidelines, listed this bus as an existing pre-1977 bus. However, it has since been determined that the bus was not operational when the Guidelines were approved.
The 2008 Guidelines require current California Highway Patrol (CHP) safety certification (CHP form 292 –Inspection Approval Certificate) as of December 31, 2005, and continuous safety certification from that point forward to receive funding. The Rim of the World bus #29 did not have the required CHP 292 certification from August 5, 2006 through April 15, 2010. In addition, the bus was not operational during this period. State funds are limited, and the CHP certification requirement was established to ensure unused buses are not revived in order to get funding.
CARB Action: Not approved for funding with LESBP state Prop 1B funds. The district may consider funding this bus with AB 923 funds, according to the guidance provided in Mail-Out MSC# 10-19.

Many of the school districts located in the Valley will equip their buses with strobe and fog lights to increase the safety of traveling in this type of weather. These items are considered optional add-ons and according to the advisory, these school districts must request a case by case to CARB to have these items deemed eligible for funding with LESBP funds. Since the fog lights are required for safety, this optional equipment may be funded.

Determination: The first lapse is of minor concern. Although CHP and school district records do not exist to substantiate a reason for the first 18 day lapse in late 2005, it is clear from odometer readings on the inspection records that the bus was actively being used approximately 15,000 miles per year between late 2003 and late 2008. Therefore, this lapse clearly does not violate the intent of the requirement for continuous CHP 292 certification to prevent the revival of unused buses in order to get funding.
However, the lapse in late 2009 is more serious. From the 12/15/08 inspection to the 3/18/10 re-certification there is a difference of only 49 miles in the odometer readings. It appears that the school district stopped using the bus very shortly after the 12/15/08 inspection. The documents supplied for review do not include an unsuccessful inspection as would normally be required at the end of 2009, and this is also evidence that the school district had stopped using the bus, but has now recently chosen to place the bus back in service after mechanical repairs in March of 2010. Based on the documentation supplied by the district, this bus is not eligible for case by case exemption from the requirement of continuous CHP 292 certification.
CARB Action: Not approved for funding with LESB state funds. Note: The district may consider funding this bus with 923 funds, according to the guidance provided in mail out 10-19.
