Railroad MOU Case Settles for $1,200
The Fall 2009, round of rail yard inspections began September 14, 2009. They will continue through October 15, 2009. SEIES staff conducts inspections at rail yards located throughout California to verify compliance with the ARB/Railroad Statewide Agreement, also known as the “Railroad MOU.” MOU provides for bi-annual inspections of rail yards at most Burlington Northern Santa Fe Railway (BNSF) and Union Pacific Railroad (UP) facilities in the state. Staff identifies locomotives that are idling excessively, producing excess VEs, or using diesel fuel that does not meet standards. The entire SEIES unit assists with MOU inspections. During September 2009, SEIES received settlements from UP in two separate enforcement actions. Penalties were collected for a total of three NOVs. All three violations involved locomotives that were idling excessively.
