Piaggio Group Americas, Inc. Case Settles for $175,000.00
On March 21, 2013, Piaggio Group Americas, Inc. (Piaggio) settled its case with the Air Resources Board (ARB) that involved multiple violations of the emission requirements applicable to its Aprilia brand of motorcycles. Specifically, Piaggio was determined to have illegally offered for sale and/or sold into California prior to 2011, a total of 40 Aprilia motorcycles of various models and model years that either: 1) had adjustable parameters that were not disclosed to ARB during the emission certification process; 2) were allowed to be adjusted by Aprilia dealers outside of their emission-certified configurations; or 3) was imported into and offered for sale into California prior to obtaining emission certification from ARB.
Piaggio fully cooperated with ARB in the subsequent investigation. The penalty amount of $175,000 for this settlement was applied to the 40 subject motorcycles at a rate of $4,375 per unit.
