Peacock Cheese Distribution Case Settles for $11,750
Peacock Cheese Distribution paid $11,750.00 in penalties for violating air quality regulations: $8,812.00 went to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $2,938.00 went to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program. This settlement was reached in December 2015.
An investigation by the Air Resources Board (ARB) showed that Peacock Cheese Distribution failed to: (1) bring six of their Transport Refrigeration Units (TRU) in compliance with the applicable in-use performance standards (2) two of their diesel trucks into compliance with the Truck and Bus (TB) regulation, and (3) failed to properly self-inspect their diesel trucks to assure the trucks met state smoke emission standards. ARB documented violations as they related to the TRU Airborne Toxic Control Measure, Periodic Smoke Inspection Program (PSIP), and the TB regulation. To settle the case, Peacock Cheese Distribution agreed to the $11,750.00 penalty and to comply with TRU, TB regulation and other ARB programs.
