Cymer, LLC Settles For $520,500
In December 2025, the California Air Resources Board (CARB) reached a settlement with Cymer, LLC (Cymer), with its principal location in San Diego, California, for the company’s violation of the Management of High‑Global Warming Potential Refrigerants for Stationary Sources (Refrigerant Management Program or RMP Regulation), as codified in California Code of Regulations, title 17, section 95380 et seq.
An investigation conducted by CARB Enforcement Division staff showed that Cymer failed to repair refrigerant leaks by the deadlines set forth in the RMP Regulation. To settle the case, Cymer agreed to the penalty of $750 per day in violation for a total settlement amount of $520,500. Terms of the settlement include a requirement for Cymer to comply with all other CARB regulations going forward.
Of the total settlement, the amount of $261,615 in civil penalty will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality. The remaining amount of $258,885 will fund three Supplemental Environment Projects (SEPs): Grab & Grow Gardens, with Healthy Day Partners ($9,036), will create 400 Grab & Grow Gardens in the San Diego area to address food insecurity and educate individuals about the environmental benefits of growing food at home; California Clean Air Day, with Coalition for Clean Air ($99,958), will facilitate committees across the state dedicated to community-based Clean Air Day participation, educate communities, and provide microgrants to lower the barrier to entry for organizations and individuals to reduce their air pollution footprint; and Installation of Air Filtration Systems San Ysidro Unified School District, with IQAir Foundation ($149,891), will install and maintain high-performance air filtration systems in two San Ysidro Unified School District schools located in disadvantaged communities disproportionately impacted by toxic air contaminants.
Cymer worked cooperatively with CARB staff to quickly resolve this matter. Further, they had no prior compliance issues and implemented additional measures to reduce the potential of any future violations.
