SD International, Inc. dba OdorFree Machines Settles For $3,500
In December 2023, the California Air Resources Board (CARB) reached a settlement with SD International, Inc. dba OdorFree Machines (SD International), with its principal location in Tallahassee, Florida, for the company’s violation of the Regulation for Limiting Ozone Emissions from Indoor Air Cleaning Devices (Indoor ACD Regulation), as codified in the California Code of Regulations, title 17, section 94800 et seq.
An investigation conducted by CARB staff revealed and documented that SD International violated the Indoor ACD Regulation because they manufactured, sold, supplied, offered for sale, and introduced into commerce in California, indoor air cleaning devices that were not certified by CARB. Indoor air cleaners are subject to an ozone emission concentration limit of 0.050 parts per million (ppm) and are required to be certified prior to sale in California. Additionally, SD International failed to include a statement excluding sales to California on webpages advertising uncertified indoor air cleaners and failed to notify distributors, retailers, and sellers of the Indoor ACD Regulation.
To come into compliance, SD International stopped the sale of uncertified indoor air cleaners in California, added a California sales exemption statement on its webpages advertising the devices, and notified all distributors of the Indoor ACD Regulation. SD International fully cooperated with CARB toward the resolution in this matter.
The penalties in this case were reduced because SD International was able to demonstrate financial hardship. The total penalty amount of $3,500 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality.
