Malibu Boats, LLC Settles For $496,500
In August 2022, the California Air Resources Board (CARB) reached a settlement with Malibu Boats, LLC (Malibu), with its principal location in Loudon, Tennessee, in the amount of $496,500 for the company’s violation of CARB’s air quality regulations.
CARB’s investigation found that Malibu failed to meet Spark-Ignition Marine Engine (SIME) emission standards longevity as required by certification. CARB documented violations as they related to the SIME Regulation (Cal. Code Regs., tit. 13, § 2440 et seq.).
Of the total amount, $248,250 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality. The balance of $248,250 will fund a Supplemental Environment Project (SEP) entitled Placer County Community Based SEP Phase 2, with Placer County Air Pollution Control District. This SEP provides Placer County schools with air filtration systems to reduce children’s exposure to Particulate Matter.
To settle the case, Malibu agreed to the penalty of $4,640 per SIME violation for a total of $496,500. Terms of the settlement include a requirement for Malibu to comply with all other CARB regulations going forward. Malibu fully cooperated with CARB to resolve this matter.
