MOTO Group, LLC, dba Rinehart Racing, Settles For $8,750
In July 2021, MOTO Group, LLC (MOTO Group) settled with the California Air Resources Board (CARB) for emissions violations related to the sale of non-exempted aftermarket motorcycle parts in California. MOTO Group, located in Arden, North Carolina, does business as Rinehart Racing and manufactures motorcycle aftermarket exhaust systems. CARB determined that MOTO Group advertised, sold, and offered for sale, aftermarket motorcycle exhaust systems and parts without legal exemptions to California’s anti-tampering laws. Such parts replace or modify critical original equipment manufacturer (OEM) emission control system components and OEM specified engine-operating conditions, and thus must be evaluated by CARB to demonstrate the vehicle’s continued emissions compliance. This conduct was in violation of California Vehicle Code section 27156 and California Code of Regulations, title 13, sections 2220 et seq.
The resulting settlement requires the company to pay a per unit penalty of $250 resulting in a total penalty of $8,750. MOTO Group has agreed to not install, sell, offer for sale, or advertise in California any aftermarket part in violation of Vehicle Code section 27156 and California Code of Regulations, title 13, sections 2220 et seq.
