Mitsubishi Engine North America, Inc. Case Settles for $20,000.00

In August 2013, Mitsubishi Engine North America (Mitsubishi) agreed to pay $20,000.00 in penalties to the California Air Pollution Control Fund for violating air quality regulations. An investigation by the Air Resources Board (ARB) showed that Mitsubishi failed to comply with the off-road compression-ignition engine regulation by neglecting to certify engine families in 2009 and 2012. One 2009 uncertified engine was sold to a California customer. Seventy-five uncertified engines were sold to customers outside of California, but were incorrectly labeled as being California compliant. To settle the case, Mitsubishi agreed to the $20,000.00 penalty and that it will not sell, offer for sale, or advertise any new non-California certified off-road compression-ignition engines for use in California. Mitsubishi has agreed to re-label all 2012 model year engines that were incorrectly labeled as California compliant so that they include no indication of California compliance. This settlement takes into consideration that Mitsubishi was cooperative throughout the enforcement process and does not have a history of violations.
