Flagship, Inc. Settles For $250,000.00
In July 2020, Flagship, Inc. (Flagship) of Elkhart, Indiana, settled its case with the California Air Resources Board (CARB) for importing, delivering, and offering for sale or sale of uncertified vehicles into California. Flagship is a Ford Authorized Specialty Vehicle Manufacturer that modified Model Year 2016 and 2017 Ford F150 Trucks with Exempted Aftermarket Parts prior to vehicle transfer to the ultimate purchaser. CARB field inspections discovered the issue, with the subsequent investigation finding 50 uncertified vehicles introduced into California in violation of Health and Safety Code sections 43151-43153.
Flagship entered into a settlement agreement with CARB and agreed to pay a total penalty amount of $250,000, or $5,000 per unit, for the uncertified vehicles. The penalty distribution will allocate $125,000 to the Air Pollution Control Fund and the remainder to Supplemental Environmental Projects. Flagship fully cooperated with CARB in resolving this matter, took immediate corrective action, developed compliant processes, and assisted in the mutual settlement of this case.
